I'm also surprised in a good way that it wasn't BS we're-sure-we-have-our-suspect-so-let' s-fabricate-or-ignore-evidence wrongful conviction but rudimentary DNA technology... of course, how the court was convinced that was enough in the first place, another story.

This is also surprising in a good way, which is sad:

The case that drove Joffe for so long was unusual because rudimentary DNA evidence had helped convict Dewey in 1996 and now newer and much more accurate DNA testing eliminated him as the perpetrator and matched up to someone who previously had not been identified as a suspect.

The case would also become a landmark because it eventually pulled prosecutors, defense attorneys and law officers into a team all working on the same goal
- to free Dewey and identify the real murderer.


You'd hope the goal would always be to get the right person, but c'est la vie.

i cant imagine spending time in jail for something I didn't do, all the time protesting that "im innocent" like everyone else, but you REALLY are. But nobody listens. Except this one lady. Hats off to her for keeping up the good fight. Now...watch them try to fark him a second time by not giving him any cash, or charging him for his wrongful incarceration.

In this case, it was. In many other wrongful convictions, the innocent person has to fight tooth-and-effing-nail against people who are really sure they're just doth protesting too much.

I know you're laying it extra thick on purpose, but I never understood the willful confusion on this matter. If your legal name was Michael, but you preferred being called "Doc", I'd refer to you both in person and in conversation as the latter. If you have a penis, but want to be referred to as a woman, same thing. Done. No hysteria, teeth-gnashing, or further contemplation of any kind. Pretty easy, really.

I was born a woman. I look like a woman. I've never had any surgery to make myself look more like a woman. I've never had a chromosome test, but I'm pretty damned sure that right down to my DNA, I'm a woman.

And if this lawyer is a woman, well, more power to her. Even if her chromosomes say something different. Even if she does look uncannily like Margo Martindale. It's not like she's declared herself a unicorn, a lampshade, or a demon goddess from Valhalla.

Haters gonna hate, but she's not hurting anyone, and she seems like a better human being than most of the trolls judging her on Fark.

If someone identifies as a female, in spite of having male reproductive organs, it's proper to refer to them in the feminine.

It's not about the bits you're born with, it's about how you see yourself within your own mind, which is why transgenders have such a hard time.

That is a false equvalency, because pregnancy is not a state of identity. Coming out as trans is in fact part of the "process" of gender transition, so once that has happened, it's considered respectful to use the pronouns of the person's identified gender. Further, in many states, surgery is no longer a requirement for gender marker change on legal documents, so the "process" may not actually be what you think it is.

A closer analogy is if your friend Bob decided he wanted to change his name to Fred. He may start introducing himself as Fred to people before actually going to the courthouse to change his legal name. Would you insist on calling him Bob until he shows you a note from a judge? Or would you just call him Fred, because he gets to decide what his own name is?
