So....are they returned to Cuba or not? I thought you had to reach land in the U.S., otherwise you are deported. I find it interesting that the article didn't even mention it, like it's assumed a Disney ship is U.S. terra firma.

The story said the ship was in Mexico right now so... they will jump ship there and cross the border illegally like everyone else! They get a second chance to do it.

So, since they didn't make land what happens with them? I believe the US law says that they only get asylum if they make it to land. If rescued at sea by the Coast Guard they're S.O.L.

Isn't it, if the ship is US-flagged? If it's Liberian-flagged, maybe they can seek asylum there (though maybe they'd prefer the Liberian Navy to return them to Cuba).

No, the Disney ships are under the flag of the Bahamas.

I was on the Disney Dream a month ago- the sister ship to the Fantasy (in TFA). If these guys are able to get anywhere in the regular guest areas (doubt it, but still), they will have their minds friggin' BLOWN. I half wonder if the crew didn't run them through the AquaDuck (the onboard water coaster) just for the hell of it.

The cruise ship would not be considered a conveyence, it would be considered a good sam. Most of the vessels that we do pull migrants off of, or seize drugs off of, we destroy so they are not hazzard to navs, or turn over to the closest government.

And if you don't think we'll confiscate a yacht, think again.

Here's what will happen. The US Coast Guard and Immigration and Customs Enforcement Agency will take them into custody. They will receive medical screenings within 24 hours and be sent to one of the several hundred detention centers throughout the US. Most likely the one near Miami.

They will receive a judicial review by a Federal Immigration law judge and dispositioned. They may get one of the folllowing: 1) remain in detention, (1A: remanded to a medical detention facility) 2) export back to Cuba, 3) export to a third country who will take them, 4) given refugee status.

Like all things, it's up to the judge to decide.

USCG and ICE cannot legally make those determinations.
