This was my first reaction, and really the man has to claim some responsibility for this, but come on: EIGHT DAYS for an immediate heart attack threat is too long. A competent doctor would have done the test same or next day.

Nevertheless, the test would not have cured his heart condition, and anyone with common sense would have stayed away from threesomes after a diagnosis like that. The man has to share some of the blame, and I think the reward will be reduced drastically on appeal.

Only question remaining is whether the doctor actually warned his patient about physical activity. If not, that could be an additional source of liability.

Doctors are just people, not infallible robots. But then again, theres supposed to be a minimum expectation of service they are supposed to provide, which is what gives them the right to practice medicine. He probably would have had the same result if he had gone to the gym or went hiking. Being a doctor is a huge responsibility, it isn't for everyone, and isn't for this guy. This guy dropped the ball.

If a mechanic let's someone drive off the lot after examingin their brakes and then the brakes fail and kill someone, yeah, I have no problem with saying that guy shouldn't be allowed to be a mechanic anymore.
