Except that you don't seem to understand that there is a difference between "choosing winners and losers" and "protecting the right to contract."

Cramming is the practice of charging people for services that have not agreed to pay for. That is a violation of basic contracting principles that have governed western civilization for hundreds of years and no one except for the most extreme anarchists suggest that government shouldn't be in the business of enforcing contract principles. Even minarchists generally agree this is one area the government must absolutely be involved in (see, for example Walter Block).

Yes, I suspect the post was sarcastic, but it was poorly used sarcasm. Government should not be in the business of picking winners and losers when everyone is playing by generally accepted contract rules. When people are breaking those rules then it is absolutely the job of the government to make sure they lose rather than win.

See the difference?

Actually I think those texts that say "Reply xxxx to this number to opt out of our service" are really saying "Reply to this text so that we know someone reads it so we can bombard you with even more text messages." But then again, it may just be that the tin foil lining in my hat needs to be adjusted.

No, theses scams work like this.

Step 1: You (or somebody you've pissed off) punches in your cell # into some website.
Step 2: You receive a text message from the scammer that says "If you don't want to sign up for our service reply 'STOP' to this number"
Step 3: Since you've never signed up for the service in the first place, and have no idea WTF it's talking about, you just delete the message.
Step 4: Your cell bill gets a 5 - 10 dollar a month third-party charge added to your bill, in the hopes that you'll never notice it.
Step 5: (optional) Some of the shadier cell providers won't refund these charges or block the scammers because they're getting a small piece of the pie.
