Except this happened in the UK where, I've been led to believe, that if you even so much as hurt the feelings of someone trespassing on your property or robbing your house you are arrested and sent to jail. I think having a firearm gets you loaded on to a catapult and shot into the sun.

What harbor view? That little spec of water in the distance that is overshadowed by the houses and other trees? Yeah, I don't think 'fail' is quite a strong enough word for this one.

If found guilty, they should do the following:

1> Fine both of them the cost of replacing the tree with a fully grown one of similar age
2> Make them replace the tree with the same kind (if possible similar age)
3> Put them in the stocks for 30days (isn't that still a tradition over there)
if the stocks aren't available, jail is ok too...

If they fail to comply within 30days for 1 and 2, then they both get to sign their houses over to the council.
I bet nobody would ever do that again :)

I'm sure I could think of a few creative ways to bring the life of a tree to an end thus requiring the council to cut it down.

If the tree was on his property it was his to cut down but upon reading the article he cut down a tree belonging to somebody else and should face charges.

If governemtn does not want me to cut down my trees ten they should compensate me for at least their value in firewood on the open market because you can be dam sure they don't hesitate to inlcude them in my property tax appraisal.(only about $60-$80 a cord right now)

Why not both?

The "Tree Surgeon" had no idea what he was doing. He didn't do a relief cut and didn't trim the uppers before felling it. He was lucky it didn't twist and take out the house next door or crush someone.

i'd replant with a Persimmon tree, then when he cuts THAT down demand the court make him pay for a new one plus lost fruit. The damn things are $2-$4 each and the tree grows tons of them, all the time.

It doesn't matter if the tree had a preservation order or not. He could not *ever* legally remove the tree, because the tree was on his neighbor's property! As in, it was not *his* tree to cut down in the first place. 

He needs to be thrown in jail, then sued for destruction of private property, preferably for everything he's worth.

So where do you draw the line? If you use your logic, people (and I use that term loosely) could cut down all trees at some point. Oh well it was only a year old (or two or three or 55, etc.) what good is it, let's cut it down. Slippery slope.
