"Deputies found the bodies of a 17-year-old boy and an 18-year-old woman in the basement of the home."

Police couldn't get to the bodies because the corpses were guarded by a Gimp.

FTA; "A person has every right to defend themselves and their homes, even employing deadly force if necessary," said Michel Wetzel, Morrison County sheriff. But the sheriff said circumstances of this incident led deputies to believe Smith went beyond that point.

Do ya think?

If I ever shoot a burglar it'll be with a shotgun. The pigs will know. Everybody in a 2 block radius will know. I'd be happy to go on TV to say I did it and I only regret there weren't more goblins to shoot.

But I was within my rights to kill them! Now I have to turn over the bodies, too?! But officer, I was going to imitate the triumphant battle scene of Achilles at the sack of Troy, dragging the corpse of Hector behind my chariot! Was I not supposed to do that?

Yeah, but you don't get to keep the corpses.

I am confused.. if you keep the bodies that is Second Degree murder, but if you call the coroner and turn them over there are no charges (as long as you can prove you shot them in your home in self defense). I can maybe see some type of lesser charge, but murder for defending yourself in your own home?

By concealing the corpses and failing to report them right away, you've lost that presumption that you were ONLY defending yourself in your own home. Now the police have to assume that something else was going on, because why else would you not have told them the truth right away?

Now, perhaps nothing WAS going on, but you see where the police can no longer take this guy at his word, he was merely defending himself?

I'm no lawyer, but I think you've put this in a nutshell.

Sorry folks, it isn't like shooting a varmint, if you kill someone you DO have to report it. Otherwise people will assume foul play. Even if you can prove they are burglars.

Well, in the guys defense, if it ends up being legit, I know a few people that lose track of time once an "event" is done. Or they just don't seem to realize that notifying someone would be a good idea in a timely manner. Could be one of those... I mean, the 2 dead aren't going anywhere, and they probably didn't start smelling yet. And, from the article, I don't get the vibe he chopped them up, or put them in the freezer.

Just saying.

FTA: "Police responded to a home around 1 p.m. in the 14000 block of Elm Street, north of Little Falls, on reports of suspicious activity Friday afternoon, Nov. 23."

Wonder what the "suspicious activity" might have been.
The shots fired around noon the day before ?

On Elm Street? I'm guessing there are lots of reports of suspicious activity related to sleep deprivation...

Whether or not posting photos of the victim holding a gun is bad or good depends entirely on if you are a defense attorney or a prosecutor.

Unless he had a very good reason for not telling the cops when it happened the failure to tell them strongly suggests it wasn't self defense. He shot them for some reason, panicked and finally decided to call it self defense as he realized he had no other way to avoid the consequences.

A short delay I can understand. If my wife were in the situation I would be very surprised if she had the presence of mind to call the cops until she had calmed down. A day, though???

Grumpyoldgeek: Probably shouldn't have put the pic of the kid holding a semi-auto pistol on the Facebook memorial page.

It says to me that he's into guns but it doesn't scream criminal to me--especially when you consider the other picture with a gun--which certainly looks like it's taken in a gun store. I'm going to guess he has some family connection to a gun store.

Those shots aren't like the usual gangbanger posing with guns pictures.

It's easy to do. I called someone a mean name once and got the chop. Pics, I dunno, some pics you wouldn't think would be offensive get axed and some--like the camel-toe thread a couple down--are gag-worthy and yet get waved past.

I've already got a spot or two picked out where I'll dump the bodies while wearing gloves and, to keep stray hair out of the scene, a cap.

I'm hoping I'll have the element of surprise on any given burglar, so that I can kill him relatively noiselessly. (I don't own a gun.)

And yeah, the old dude looks like he HAS NO EYES, so I'm surprised he shot anyone.

Followup story says one of the kids was misbehaving, and the guy had been burgled several times.
A relative of the kids says a defender should shoot in the shoulder, instead of shooting to kill. Apparently weakly understands the real world.

Further followup says the idiot home owner used a .22 and shot a total of 8 times, including a "finishing shot".

Here to tell you, don't use a .22 for home defense. Use a 12 gauge with slugs/00, so you only have to shoot the intruders once or twice. That way, instead of having to answer why you kept shooting them, they are already dead, and you won't go to jail for protecting yourself.
