Look, douchebags, remove the whale, THEN argue over who is responsible for it. If it was my house, I'd hire someone with a front loader to bury the damn thing, then sue the city, state, county, whoever, at my leisure, AFTER the goddamn thing was gone and I didn't have to smell it any more. There are times to stand on principle, and times to get a rotting whale carcass underground. |

If they have the right to keep the public off their beach, they have the right to remove their own whale carcasses. Same principle as applies to the yard waste I pile on the curb every fall. |

They can't keep the public off the beach, David Geffen and other residents have been forced since 2005 to grant public access as they lost their court cases. The coast belongs to the public up to and including the mean high tide line, or where it would be if sea walls and levees had not been built. I would take this as meaning that it is the city of Malibu that should be disposing of the whale carcass, and besides that 40,00lbs is in and around open water is a public health problem. Link |
